By browsing the Site or making a booking enquiry, you acknowledge that you have read and agreed to these Terms of Use. If you do not accept these terms, please do not use the Site or our services. The Velvet Nest FZ-LLC reserves the right to modify these terms at any time; changes take effect as soon as they are published on the Site. Your continued use of the Site after any modification constitutes your acceptance of the revised terms.
2. Evolution & Duration
2.1 Service Availability
The Velvet Nest FZ-LLC reserves the right to modify, suspend or permanently discontinue any aspect of the Site or its services at any time and without prior notice. The Velvet Nest FZ-LLC accepts no liability for any interruption of service resulting from technical events outside its control, including but not limited to internet outages, server failures, or force majeure.
2.2 Duration
These Terms of Use apply for as long as the Site is accessible online. A service booking agreement, once entered into via the Time To Pet platform, is governed separately by the terms accepted during account creation and any specific agreements reached with The Velvet Nest FZ-LLC directly.
3. Site Access
3.1 General Access
The Site is accessible free of charge from anywhere with an internet connection. Any cost related to accessing the Site (hardware, software, internet connection) is the sole responsibility of the user. The Velvet Nest FZ-LLC makes no warranty regarding the accuracy or completeness of the information provided on the Site and reserves the right to remove or modify content at its sole discretion, without notice and without liability.
3.2 Client Portal Access
Clients who have created an account on the Time To Pet platform are responsible for maintaining the confidentiality of their login credentials and for all activity conducted through their account. Any suspicious or unauthorised access should be reported to The Velvet Nest FZ-LLC immediately.
4. Limitation of Liability
4.1 Website Liability
The information published on this Site is provided for general information purposes only and does not constitute professional or legal advice. The Velvet Nest FZ-LLC cannot be held liable for any direct or indirect damages caused by the use of, or inability to use, the Site or the information it contains. This includes, without limitation, loss of business, loss of data, technical failures, or inaccuracies in the content.
4.2 Service Liability
The Velvet Nest FZ-LLC takes the utmost care in providing its cat sitting services and will always act in the best interests of the animals in its care. However, The Velvet Nest FZ-LLC cannot be held liable for circumstances beyond its reasonable control, including health incidents arising from pre-existing conditions, incidents not foreseeable despite reasonable vigilance, or access problems resulting from inaccurate information provided by the client.
Clients are required to provide accurate and complete information about their pet's health, behaviour, dietary needs and any relevant conditions prior to the first service, and to notify The Velvet Nest FZ-LLC immediately of any material changes.
5. Intellectual Property
All content on this Site, including but not limited to text, photographs, illustrations, logos, graphic elements and the overall design, is the exclusive property of The Velvet Nest FZ-LLC or is used with the express permission of rights holders. This content is protected by UAE intellectual property law.
Any reproduction, distribution, modification, adaptation or publication of the Site's content, in whole or in part, by any means and for any purpose, is strictly prohibited without the prior written consent of The Velvet Nest FZ-LLC. Permitted use is limited to private, non-commercial viewing on a personal device.
6. Hyperlinks
The Site may contain links to third-party websites. These links are provided for convenience only. The Velvet Nest FZ-LLC has no control over the content, privacy practices or availability of those sites and cannot be held liable for any damage arising from their use.
Any third party wishing to establish a hyperlink to this Site must obtain prior written authorisation from The Velvet Nest FZ-LLC. In all cases, the link must not be created in a way that could mislead users about the nature of the relationship between The Velvet Nest FZ-LLC and the linking site.
7. Personal Data Protection
The Velvet Nest FZ-LLC processes personal data in accordance with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (the "UAE PDPL") and any implementing regulations.
7.1 Data Collected
In the course of providing its services and operating the Site, The Velvet Nest FZ-LLC may collect the following personal data: full name, email address, phone number (including WhatsApp), home address, information about your cat (name, breed, age, health, behaviour, and veterinary contact), booking history and service preferences, and technical browsing data collected via cookies.
7.2 Purpose of Processing
Your personal data is collected and processed for the following purposes: managing your client account and service bookings; providing cat sitting services safely and in accordance with your instructions; processing payments; communicating with you about visits, invoices and updates; and, where you have explicitly consented, sending you news and service updates about The Velvet Nest.
7.3 Data Sharing
Your data will not be sold to third parties. It may be shared with service providers who support our operations, specifically our booking platform (Time To Pet) and payment processor (Stripe), who are both bound to process data securely and in accordance with their respective data protection obligations. It may also be shared with your cat's veterinary provider in the event of an emergency, and with competent legal or governmental authorities where required by UAE law.
7.4 Data Security
The Velvet Nest FZ-LLC takes appropriate technical and organisational measures to protect your personal data against unauthorised access, accidental loss, destruction or disclosure. Access to client data is restricted to the extent necessary for the purposes described above.
7.5 Your Rights
Under the UAE PDPL, you have the right to access, correct, delete or restrict the processing of your personal data. You may also withdraw consent to marketing communications at any time, and request portability of your data where technically feasible. To exercise any of these rights, contact us at segolene@thevelvetnest.me. You also have the right to lodge a complaint with the UAE Data Office if you believe your rights have not been respected.
